Terms of Service

Welcome to Selah. These Terms of Service ("Terms") govern your access to and use of www.selahpsalm.org, the Selah mobile application, and related services (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 13 years old to use Selah (and, in Korea, users under 14 require the consent of a legal guardian). By using the Service, you represent that you meet this requirement.

2. Your Account

• You are responsible for maintaining the confidentiality of your account credentials.
• You agree not to share your password with others.
• You are responsible for all activity that occurs under your account.
• Notify us immediately of unauthorized account access at support@selahpsalm.org.

3. Your Content

• You retain ownership of any content you create in Selah (journal entries, workout logs, etc.).
• You grant Selah a limited license to store, display, and process your content solely for the purpose of providing the Service to you.
• You are solely responsible for the content you create. Do not submit content that is unlawful, harassing, or infringes the rights of others.

4. AI Features and Disclaimers

Selah uses third-party cloud AI providers to generate responses. Important:

• AI output is informational only. The Selah Trainer, Selah AI companion and counsel, weekly debrief, and similar features produce AI-generated content, which may contain errors, omissions, or inaccuracies.
• Not medical advice. Health, fitness, nutrition, and mental-well-being outputs are not medical advice. Consult a qualified professional before acting on them.
• Not a crisis or emergency service. Selah does not provide emergency, crisis, or mental-health treatment. If you are in danger, thinking of harming yourself, or in crisis, contact your local emergency number or a crisis hotline immediately. AI responses are not a substitute for professional help.
• Not financial advice. Any asset or financial output is not investment advice.
• Not spiritual or theological authority. Scripture paraphrase and reflections are AI-generated reformulations and not authoritative interpretations.
• You acknowledge that AI providers may evolve their models over time, and outputs may vary.

5. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to gain unauthorized access to other users' accounts or data.
• Reverse engineer, scrape, or extract data from the Service except via official user-facing features.
• Use the Service to send spam or harassing content.
• Use automated tools to access the Service without prior written permission.
• Submit content that infringes third-party intellectual property rights.

6. App Stores

If you download the Selah app from a third-party app store (such as the Apple App Store or Google Play), your use is also subject to that store's terms. Where you obtained the app from Apple: you and Selah acknowledge that these Terms are between you and Selah only, not Apple; Selah, not Apple, is responsible for the app and its content and support; and Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

7. Service Availability

The Service is provided "as is" and "as available." We do not guarantee uninterrupted access. We may modify, suspend, or discontinue features at any time, with or without notice.

8. Termination

• You may terminate your account at any time by emailing support@selahpsalm.org.
• We may suspend or terminate your account if you violate these Terms or engage in conduct harmful to other users or the Service.
• Upon termination, your right to use the Service ends immediately.

9. Disclaimer of Warranties

The Service is provided "AS IS" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the fullest extent permitted by law, Selah and its affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages, or for loss of profits or data, arising out of your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you have paid us in the 12 months preceding the claim (or $100 if you have paid nothing). Nothing in these Terms limits any liability that cannot be limited under applicable law.

11. Indemnification

You agree to indemnify and hold harmless Selah from any claims arising from your use of the Service, your content, or your violation of these Terms.

12. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court. You and Selah agree to waive any right to a jury trial or to participate in a class action.

Mandatory local law prevails. If you are a consumer, nothing in this section deprives you of the protections of mandatory consumer-protection laws of the country where you live. For example, consumers in the Republic of Korea retain the rights granted by Korean law (including the right to use the Korea Consumer Agency and the Personal Information Dispute Mediation Committee), and consumers in the EEA/UK retain their local statutory rights, where those laws apply notwithstanding the choices of law and forum above.

13. Changes to Terms

We may update these Terms. Material changes will be announced via the Service. Continued use after such updates constitutes acceptance.

Selah를 이용해주셔서 감사합니다. 본 약관은 www.selahpsalm.org, Selah 모바일 앱 및 관련 서비스("서비스") 이용을 규정합니다. 계정 생성 또는 서비스 이용 시 본 약관에 동의하는 것으로 간주됩니다.

1. 이용 자격

만 13세 이상이어야 Selah를 이용할 수 있습니다(한국에서는 만 14세 미만 사용자는 법정대리인의 동의가 필요합니다). 이용 시 이 요건을 충족함을 보증합니다.

2. 계정

• 계정 자격증명의 보안은 본인 책임입니다.
• 비밀번호를 타인과 공유하지 마세요.
• 계정에서 발생한 모든 활동은 본인 책임입니다.
• 무단 접근 발견 시 즉시 support@selahpsalm.org로 알려주세요.

3. 사용자 콘텐츠

• Selah에서 작성한 모든 콘텐츠(일기, 운동 기록 등)의 소유권은 본인에게 있습니다.
• Selah는 서비스 제공 목적에 한해 콘텐츠를 저장·표시·처리할 제한적 라이선스를 부여받습니다.
• 콘텐츠에 대한 책임은 본인에게 있습니다. 불법, 괴롭힘, 권리 침해 콘텐츠를 작성하지 마세요.

4. AI 기능 및 면책

Selah는 제3자 클라우드 AI 제공자를 이용해 응답을 생성합니다. 중요:

• AI 출력은 정보 제공 목적입니다. 셀라 트레이너, Selah AI 동반자·상담, 주간 회고 등은 AI가 생성한 콘텐츠이며 오류·누락·부정확성을 포함할 수 있습니다.
• 의학적 조언이 아닙니다. 건강·운동·영양·정신적 웰빙 출력은 의학적 조언이 아니며, 행동 전 전문가와 상담하세요.
• 위기·응급 서비스가 아닙니다. Selah는 응급·위기·정신건강 치료를 제공하지 않습니다. 위험하거나, 자해를 생각하거나, 위기 상황이라면 즉시 지역 긴급전화나 위기 상담 전화로 연락하세요. AI 응답은 전문적 도움을 대체하지 않습니다.
• 재정적 조언이 아닙니다. 자산·재정 관련 출력은 투자 조언이 아닙니다.
• 영적·신학적 권위가 아닙니다. 성경 paraphrase 및 묵상은 AI 재구성이며 권위 있는 해석이 아닙니다.
• AI 제공자는 모델을 업데이트할 수 있으며, 출력은 변할 수 있습니다.

5. 금지 행위

• 서비스를 불법 목적으로 사용
• 다른 사용자 계정·데이터에 무단 접근 시도
• 공식 사용자 기능 외 방법으로 데이터 reverse engineering, scraping, 추출
• 스팸 또는 괴롭힘 콘텐츠 전송
• 사전 서면 허가 없이 자동화 도구로 서비스 접근
• 제3자 지식재산권 침해 콘텐츠 제출

6. 앱 스토어

Selah 앱을 제3자 앱 스토어(예: Apple App Store, Google Play)에서 내려받은 경우, 이용에는 해당 스토어의 약관도 적용됩니다. Apple에서 앱을 받은 경우: 본 약관은 Apple이 아니라 사용자와 Selah 간의 계약이며; 앱과 그 콘텐츠·지원에 대한 책임은 Apple이 아니라 Selah에 있고; Apple과 그 자회사는 본 약관의 제3수익자로서 사용자에게 본 약관을 집행할 수 있습니다.

7. 서비스 가용성

서비스는 "있는 그대로(as is)" 및 "이용 가능한 한도 내(as available)"로 제공됩니다. 중단 없는 접근을 보장하지 않습니다. 사전 통지 여부와 무관하게 기능을 변경·중단할 수 있습니다.

8. 종료

• 언제든 support@selahpsalm.org로 계정 종료 요청 가능.
• 본 약관 위반 또는 다른 사용자·서비스에 해를 끼치는 행위 시 계정 정지·종료될 수 있습니다.
• 종료 시 서비스 이용 권리는 즉시 종료됩니다.

9. 보증의 부인

서비스는 명시적·묵시적 어떠한 보증 없이 "있는 그대로" 제공됩니다. 상품성, 특정 목적 적합성, 비침해의 보증을 포함합니다.

10. 책임 제한

법이 허용하는 최대 범위 내에서 Selah는 서비스 이용으로 인한 간접·우발·결과적·특별·징벌적 손해, 또는 이익·데이터 손실에 대해 책임지지 않습니다. 청구 관련 총 책임은 청구 전 12개월간 지급한 금액(지급 없으면 $100)을 초과하지 않습니다. 본 약관의 어떤 내용도 관련 법상 제한할 수 없는 책임을 제한하지 않습니다.

11. 면책

서비스 이용, 콘텐츠, 본 약관 위반으로 발생한 청구에서 Selah를 면책할 것에 동의합니다.

12. 준거법 및 분쟁 해결

본 약관은 법 충돌 원칙과 무관하게 미국 델라웨어주 법에 의해 규율됩니다. 본 약관 관련 분쟁은 미국 중재협회 규칙에 따른 구속력 있는 중재로 해결합니다. 단 어느 쪽이든 법원에 가처분을 신청할 수 있습니다. 사용자와 Selah는 배심원 재판 권리 및 집단 소송 참여 권리를 포기함에 동의합니다.

강행 현지법 우선. 사용자가 소비자인 경우, 본 조항의 어떤 내용도 거주 국가의 강행 소비자보호법상 보호를 박탈하지 않습니다. 예를 들어 대한민국 소비자는 한국 법이 부여하는 권리(한국소비자원 및 개인정보분쟁조정위원회 이용 권리 포함)를, EEA/영국 소비자는 현지 법정 권리를, 해당 법이 위 준거법·관할 선택에도 불구하고 적용되는 한도에서 그대로 보유합니다.

13. 약관 변경

본 약관은 변경될 수 있으며, 중요한 변경은 서비스 내 공지됩니다. 변경 후 계속 이용 시 동의로 간주됩니다.
